General Terms and Conditions of Sale of WONDERSTRIPES Cosmetics GmbH

WONDERSTRIPES is registered as a design and as a word/image mark and enjoys the associated protective rights!

The following terms and conditions apply to all contracts, deliveries and services between WONDERSTRIPES Cosmetics GmbH (hereinafter also: “we”, “us”) and its customers (hereinafter also: “you”).

1. Conclusion of contract
The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By clicking the "Buy" button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order will follow immediately after the order has been sent and does not constitute acceptance of the contract. We can accept your order by sending a shipping or order confirmation by email or by delivering the goods within five days. If acceptance is not made within this period, you are no longer bound to your order.

2. Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier. You must return the goods to us promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

3. Exclusion or expiry of the right of withdrawal
According to Section 312g Paragraph 2 of the German Civil Code (BGB), a right of withdrawal does not exist, among other things, for contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, and it expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

4. Prices
All prices quoted on the WONDERSTRIPES Cosmetics GmbH website are subject to change and include applicable VAT. We will check prices when we process your order. In the unlikely event that a product is incorrectly priced and the correct price is higher than the price on the website, we will contact you before dispatching the goods to ask you whether you wish to purchase the product at the correct price or cancel the order.

5. Statutory warranty law
The statutory warranty period is two years. The period begins when the goods are handed over. For all defects in the purchased item that occur during the statutory warranty period, you have the option of claiming subsequent performance, remedying the defect/new delivery and - if the statutory requirements are met - further claims for reduction or withdrawal as well as compensation for damages, including compensation for damages instead of performance and compensation for wasted expenditure.

6. Delivery times
We usually deliver goods in stock within Germany within 3 to 4 working days, within Europe within 4 to 7 working days, to the delivery address you have specified, and to delivery addresses outside Europe within 5 to 9 working days. If, in exceptional circumstances, an item is not available or cannot be delivered as quickly, we will inform you of the delivery date as soon as possible. If a specific item is not available, we undertake to inform you of the unavailability before accepting your order. We would like to point out that all information on the availability, shipping or delivery of a product is only estimated information and approximate guidelines. They do not represent binding or guaranteed shipping or delivery dates, unless this is expressly stated as a binding date in the shipping options for the respective product.

7. Shipping costs
Delivery is only made by post with Deutsche Post or DHL. We charge the following costs for delivery and packaging: Shipping costs .

8. Payment
The purchase price can be paid by credit card, PayPal, Amazon Payments, Sofortüberweisung or advance payment by bank transfer. However, we reserve the right not to offer certain payment methods for each order and to refer to other payment methods. If you live outside of Germany, payment can be made by credit card, PayPal (information on the countries in which payment by PayPal is possible can be found at www.paypal.com .), Amazon Payments, Sofortüberweisung (information on the countries in which payment by Sofortüberweisung is possible can be found at www.sofort.com .) or advance payment by bank transfer.

9. Retention of title

The goods remain the property of WONDERSTRIPES Cosmetics GmbH until the purchase price has been paid in full.

10. Liability:

WONDERSTRIPES Cosmetics GmbH is liable without limitation if the cause of the damage is based on an intentional or grossly negligent breach of duty by WONDERSTRIPES Cosmetics GmbH or a legal representative or vicarious agent of WONDERSTRIPES Cosmetics GmbH. Furthermore , WONDERSTRIPES Cosmetics GmbH is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance you regularly rely. In this case, however , WONDERSTRIPES Cosmetics GmbH is only liable for foreseeable, contract-typical damage. WONDERSTRIPES Cosmetics GmbH is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

The above limitations of liability do not apply in the event of injury to life, body or health, for a defect after a guarantee has been given for the quality of the product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected. Insofar as the liability of WONDERSTRIPES Cosmetics GmbH is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

12. Copyright and industrial property rights
The content on the websites operated by WONDERSTRIPES Cosmetics GmbH is subject to German copyright and/or other industrial property rights. The reproduction, processing, distribution and other use of the content requires the prior written consent of WONDERSTRIPES Cosmetics GmbH . Insofar as the content on this site was not created by the operator, the copyrights of third parties are observed. In particular, third-party content is marked as such. Should you nevertheless become aware of a copyright infringement, we ask you to notify us accordingly. If we become aware of any infringements, we will remove such content immediately.

13. Miscellaneous
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Hamburg, unless another place is required by law.

WONDERSTRIPES Cosmetics GmbH reserves the right to make changes to the online shop and the terms of sale at any time. Your order will be subject to the terms of sale in effect at the time you place your order, unless a change to these terms is required by law or by official order (in which case they will also apply to orders you have previously placed). If any provision in these terms of sale is invalid, void or unenforceable for any reason, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
